  • Public Notice 2019-278 Extension

    This Public Notice is related to an earlier USACE Public Notice (CENAP-OP-R-2019-278), issued and re-issued by the USACE Philadelphia District on 24 July and 30 July 2020. Those previous notices, and this new notice, are associated with an application for a Department of the Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344) by the Diamond State Port Corporation (DSPC) to discharge fill material and to conduct dredging and disposal activities within, and adjacent to, navigable waters of the United States at the proposed Port of Wilmington, Edgemoor Expansion project site. In addition, DSPC has requested USACE permission under 33 USC 408 (Section 14 of the Rivers and Harbors Act of 1899; hereinafter Section 408) to utilize a portion of the Main Navigation Channel of the Delaware River, Philadelphia to Sea Federal Navigation Project as their ship turning basin. The purpose of this notice is two-fold: to extend the comment period of Public Notice CENAP-OP-R-2019-278, and to clarify the description of one of the activities (the ship turning basin) under review by USACE.     The purpose of this notice is to inform the public that repairs of damage to public and private property caused by Tropical Storm/Hurricane Isaias and associated flooding and weather conditions, may be authorized, subject to the procedures described below in Maryland, the District of Columbia, certain military installations in northern Virginia, and Pennsylvania.     The applicant, Sea Isle City, proposes to perform mechanical and hydraulic dredging within Ludlam Thorofare along private properties adjacent to 38th Street and Venicean Road as well as various lagoon locations between 49th Street and John F. Kennedy Boulevard, City of Sea Isle City, Cape May County, New Jersey. More details are available in the "Public Notice & Plan Details" attachment. Public comments are due by Sept. 11, 2020.

    Expiration date: 9/9/2020

    The applicant, Delaware City Refining Company LLC, proposes to perform maintenance dredging at the Delaware City Refining facilities navigation channel, berthing area and the cooling water intake channel. Dredged material would be disposed on property identified as 1771 River Road and 22 Washington Street, all sites located within Delaware City, New Castle County, Delaware. The applicant's stated purpose is to allow access to the refinery and the need for the increased depth at the site is to maintain ship access and to reduce ship/barge traffic and lightening events for vessels using the site.
