SWANCC and Isolated Wetlands

Starting April 1, 2004, USACE HQ required information sheets for preliminary and final determinations of no jurisdiction to be posted on District sites. The purpose of the reporting requirements is to identify those instances where the Corps has made a determination that the project site contains isolated waters/wetlands that are not jurisdictional because of SWANCC. In addition, this reporting requirement covers those instances when there is a combination of jurisdictional waters/wetlands and non-jurisdictional waters/wetlands based on SWANCC.   EPA SWANCC Information

The Philadelphia District Quarterly Public Notice of Final Actions will now include COE non-jurisdiction determinations related to SWANCC.

Listed below are the information sheets for determinations of no jurisdiction for isolated, non-navigable intra-state waters resulting from U.S. Supreme Court decision in Solid Waste Agency of Northern Cook County vs. U.S. Army Corps of Engineers.
