This Public Notice is related to an earlier USACE Public Notice (CENAP-OP-R-2019-278), issued and re-issued by the USACE Philadelphia District on 24 July and 30 July 2020. Those previous notices, and this new notice, are associated with an application for a Department of the Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344) by the Diamond State Port Corporation (DSPC) to discharge fill material and to conduct dredging and disposal activities within, and adjacent to, navigable waters of the United States at the proposed Port of Wilmington, Edgemoor Expansion project site.
In addition, DSPC has requested USACE permission under 33 USC 408 (Section 14 of the Rivers and Harbors Act of 1899; hereinafter Section 408) to utilize a portion of the Main Navigation Channel of the Delaware River, Philadelphia to Sea Federal Navigation Project as their ship turning basin. The purpose of this notice is two-fold: to extend the comment period of Public Notice CENAP-OP-R-2019-278, and to clarify the description of one of the activities (the ship turning basin) under review by USACE. More details are available in the attached Public Notice document. Public comments are due by Oct. 1, 2020.
