  • Special Public Notice 25-03

    The purpose of this notice is to advise the public that the United States Army Corps of Engineers, North Atlantic Division has approved use of emergency permit processing procedures for New Jersey, in accordance with 33 CFR § 325.2(e)(4), for the National Energy Emergency established by Executive Order (E.O.) 14156, issued on January 20, 2025. These special emergency processing procedures have been established pursuant to Sec. 4 of E.O.14156 for activities associated with the identification, siting, production, transportation, refining, and generation of domestic energy sources, including energy infrastructure, that require Department of the Army authorization under Section 10 of the Rivers and Harbors Act of 1899, Section 404 of the Clean Water Act, and/or Section 103 of the Marine Research, Protection, and Sanctuaries Act of 1972. More details are available in the Special Public Notice document and in the E.O. 14156 Federal Register notice.

These special emergency processing procedures have been established pursuant to Sec. 4 of E.O.14156 for activities associated with the identification, siting, production, transportation, refining, and generation of domestic energy sources, including energy infrastructure, that require Department of the Army authorization under Section 10 of the Rivers and Harbors Act of 1899, Section 404 of the Clean Water Act, and/or Section 103 of the Marine Research, Protection, and Sanctuaries Act of 1972.     The permit applicant, EMR Eastern, LLC, has requested Department of the Army authorization to upgrade there existing docking facility including approximately 12.7 acres of dredging and new dolphin construction all within the Delaware River. The site is located in the City of Camden, Camden County, New Jersey. The stated purpose of the project is to allow for EMR to load larger, deeper draft vessels, thereby allowing diversity in the types of vessels that can access EMR's existing facility.

    The permit applicant, the Burlington County Bridge Commission, has requested Department of the Army authorization to replace submarine cables within the footprint of the Delaware River’s Philadelphia to Trenton Federal Navigation Channel between Pier “E” and Pier “F” at the bascule span of the Tacony-Palmyra Bridge in the Borough of Palmyra, Burlington County, New Jersey. The stated purpose of the project is to replace existing submarine cables which are approaching their end-of-service life, as well as upgrade information technology and communications infrastructure for devices installed on the bridge.
