    This District has received an application for a Department of the Army permit pursuant to Section 404 of the Clean Water Act (33 U.S.C. 1344). The applicant proposes to construct a two-warehouse commercial development with attendant infrastructure; including site ingress and egress, truck courts, trailer storage, employee parking, and stormwater facilities; on an approximately 102-acre site. The proposed project commencement date is July 2025, and the proposed completion date is July 2028. On-site land use is primarily agricultural with forested buffer areas. 6.42 acres of wetlands and 1.70 acres (5,542 linear feet) of streambed exist on-site. Of these aquatic resources, the proposed project would affect 0.80 acres of wetlands and 0.04 acre (387 linear feet) of streambed, or approximately 13% of wetlands and 7% of streams. The aquatic resources are within the Maiden Creek watershed, and their general arrangement on-site includes two tributaries and associated wetlands flowing from east to west and traversing the site.

    This notice finalizes the reissuance of the Department of the Army Delaware State Programmatic General Permit-20 (SPGP-20), initially issued on March 23, 1984. This general permit authorizes certain existing and proposed piers, docks, mooring piles, boat lifts, breakwaters, and the replacement of existing serviceable bulkhead structures in navigable waters of the United States within the geographic boundaries of the Philadelphia District Corps of Engineers in the State of Delaware. This general permit has been developed for certain clearly described categories of minor projects involving structures and fill that require Department of the Army and State of Delaware authorizations. The reissuance and modification of SPGP-20 was coordinated with other interested Federal agencies, the State of Delaware, and the general public. The reissuance of SPGP-20 includes minor language changes and additional conditions to address the EFH provisions of Magnuson Stevens Act, EPA comments and National Park Service comments.     Expiration date: 3/10/2025

    The proposed activity involves performing hydraulic maintenance dredging of approximately 6 miles of the Indian River Federal Navigation Channel in Sussex County, Delaware, from the Indian River Bay confluence with the Indian River to Cupola Park in the town of Millsboro. Approximately 360,000 cubic yards of material will be dredged from the waterways and used for wetland restoration and thin layer placement along the Indian River shoreline. The proposal identifies 3 wetland restoration sites and 3 thin layer placement sites. The material will be contained at the placement sites utilizing coir logs, armored sand containment dikes or geotubes. More details are available in Public Notice & Plan documents. Public comments are requested by March 10, 2025.
