  • New Jersey State Programmatic General Permit 17

    This General Permit authorizes the construction of structures; work and the discharge of dredged and fill material in substantially developed artificial tidal lagoons in the State of New Jersey. This general permit is applicable to the appropriate navigable waters located within the geographic boundaries of both the Philadelphia District and the New York District of the U.S. Army Corps of Engineers. This General Permit has been reissued for a period of five (5) years. It expires on December 31, 2022. At that time, an assessment of the cumulative impacts of this General Permit will be done to determine if the general permit should be continued.

    This general permit has been developed for certain categories of structures and work and the discharge of dredged and fill material in waters of the U.S. that require Department of the Army and State of Delaware authorizations. Activities typically authorized by SPGP-18 include work and structures such as bulkheads, breakwaters, piers, docks, pilings, rip-rap, dredging and filling, etc. The revalidation and extension of SPGP-18 was coordinated with other interested Federal agencies, the State of Delaware, and the general public.     The applicant, the U.S. Fish & Wildlife Service, proposes to perform thin layer deposition of sediment across a degraded tidal salt marsh. This thin layer deposition will be conducted by spreading approximately 68,487 cubic yards (CY) of suitable dredged sediment into a series of eight (8) cells. The work will be performed in Barnegat Bay/Metedeconk River in Brick Township, Ocean County, New Jersey. More details are available in the "Public Notice & Plan Details" attachment. Public comments are due by Feb, 17, 2018.

    The applicant has requested a Department of the Army permit to install a 6' x 35' fixed dock and a 14' x 14' boat lift on 4 pilings in the Lewes and Rehoboth Canal at 9 Breakwater Street (Tax Map Parcel #3-35-4.14-61.00), Lewes, Sussex County, Delaware.     Reference is made to Public Notice CENAP-OP-R-2017-703-85 dated December 4, 2017 describing an application by the Delaware Department of Natural Resources and Environmental Control (DDNREC), Division of Fish and Wildlife for a Department of the Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344) to continue the deployment of artificial reef materials at 14 previously authorized artificial reef sites located in the Delaware Bay and Atlantic Ocean. The purpose of our public notice is to solicit comments and recommendations from the public concerning issuance of a Department of the Army permit for the proposed work described therein. The comment period for the previous public notice expired on January 4, 2017. The purpose of this notice is to advise the public of the DDNREC request to amend the vertical clearance requirement for artificial reef site #6, reducing the minimum vertical clearance from 25 feet to 15 feet.
