    The applicant, Delaware Department of Natural Resources and Environmental Control Division of Watershed Stewardship, has applied for a permit to nourish a severely eroded section of the Delaware Bay shoreline, via truck-fill method at Bowers Beach, Kent County, Delaware. Approximately 6,300 cubic yards of sand from an inland borrow source will be used to restore 2 areas. More details are available in the attached "Public Notice and Plan Details" document. Public comments are due by September 29, 2017.

    The PennEast project proposed by the applicant is to construct 120.2 miles of new 36-inch diameter natural gas pipeline. This Public Notice concerns the work associated with five separate single and complete crossings of waters and/or wetlands associated with the PennEast project of constructing the proposed PennEast Pipeline. The PennEast project is under the jurisdiction of the Federal Energy Regulatory Commission (FERC) which issued a Final Environmental Impact Study (FEIS) on April 10, 2017 for the PennEast project. The U.S. Army Corps of Engineers is a cooperating agency on that document. More details are available in the attached "Public Notice & Plan Details" attachment.     The applicant, the American Littoral Society, using Department of the Interior and National Fish and Wildlife Foundation funds, proposes to perform habitat restoration within Thompson’s Beach Marsh. This will be accomplished by dredging two existing creek channels and using the dredge sediment on two selected areas within the marsh: “The Eastern Project Site” at 3.75 acres, and “The Southern Project Site” at 9.95 acres. The total area of impact will be no greater than 18.50 acres including the area to be dredged. The habitat restoration site and dredging are both located in Maurice River Township, Cumberland County, New Jersey. Dredging is not in a navigable channel. More details are available in the "Public Notice and Plan Details" attachment. Public comment deadline is on Oct. 7, 2017.

  • Proposed rule "Definition of "Waters of the United States"

    Today (July 27, 2017) the proposed rule "Definition of ‘‘Waters of the United States’’—Recodification of Pre-Existing Rules" was published in the Federal Register for a 30-day public comment period. This is the proposed rule for the first step of the effort associated with the Executive Order, signed on 28 February 2017, ‘‘Restoring the Rule of Law, Federalism, and Economic Growth by Reviewing the ‘Waters of the United States’ Rule.’’ See attached Federal Register notice for more information.

    Reference is made to Department of the Army General Permit SPGP-17 issued on December 9, 1982 authorizing the construction of structures, work and the discharge of dredged and fill material in substantially developed artificial or man-modified tidal lagoons in the State of New Jersey. This general permit is applicable to the appropriate navigable waters located within the geographic boundaries of both the Philadelphia District and the New York District of the U.S. Army Corps of Engineers. Notice is hereby given that the United States Army Corps of Engineers, Philadelphia District, proposes to revalidate and extend the expiration date of the above referenced Department of the Army General Permit from December 31, 2017 until December 31, 2022.
