    Reference is made to an application for a Department of the Army permit pursuant to Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act (33 U.S.C. 1344), submitted by GHD, Inc. on behalf of the City of Rehoboth to install a wastewater outfall pipeline and diffuser via directional drilling and mechanical or hydraulic dredging in the Atlantic Ocean east of Deauville Beach, Rehoboth Beach, Sussex County, Delaware. The purpose of this notice is to respond to comments from the general public in response to our public notice for this application issued on September 2, 2016. After a complete review of the permit application and in full consideration of the comments and recommendations received in response to our public notice, we have decided to issue a Department of the Army permit to the City of Rehoboth. No objections to the issuance of this permit were received from State, local and other Federal resource agencies (Delaware Department of Natural Resources and Environmental Control (DDNREC), Environmental Protection Agency (EPA), Fish and Wildlife Service, and the National Marine Fisheries Service (NMFS)) concerning the effects of the proposed work on resources within their jurisdictions.     The applicant, Sunoco Logistics, Inc., proposes to perform maintenance dredging of two berthing areas to their docks A and B at the Fort Mifflin Terminal at 4 Hog Island Road within the Delaware River. Dredging would be by mechanical or environmental clamshell dredging within an area encompassing a maximum of 12.6 acres. The applicant anticipates up to four additional dredging events within 10 years with no more than 150,000 cubic yards of material in total.     The applicant proposes to hydraulically dredge accumulated sediment from within portions of Cooks Creek between Lake Louise and Manasquan River in Point Pleasant Beach Borough, Ocean County, New Jersey. Maintenance dredging would consist of hydraulic dredging of approximately fourteen thousand one hundred forty three cubic yards (~14,143 cy) of sediment comprised of sand and silt, from approximately one thousand (~1,000) feet of the Cooks Creek. Material would be hydraulically dredged and transported via pipeline to the Gull Island CDF. The applicant has requested a 10-year maintenance dredging permit.     The applicant, Hometown Angola Beach, LLC, has applied for a Department of the Army permit to conduct hydraulic dredging of 8,500 cubic yards of accumulated sediment in 2.5 acres of waters of the United States to a depth of -4’ MLW for the Angola Beach and Estates Marina in Sussex County, Delaware. The dredged material will be hydraulically pumped to an existing confined disposal site located in Angola by the Bay. The applicant is requesting a 10 year maintenance permit for hydraulic dredging. Furthermore, the applicant is proposing to expand the marina from 72 slips to 120 slips. More details are available in the "Public Notice & Plan Details" attachment.
