    The Philadelphia District U.S. Army Corps of Engineers (Corps) has received a Prospectus to establish a compensatory wetland mitigation bank for Department of the Army permits in accordance with the Federal Rules; “Compensatory Mitigation for Losses of Aquatic Resources”; Final Rule (33 CFR Parts 332 and 40 CFR Part 230) of April 10, 2008. The proposed Quaker Mitigation Bank site is located in Kempton, Berks County, Pennsylvania within 5 parcels, privately owned, principally used for agricultural production and cattle pasture. The purpose of this notice is to solicit comments and recommendations from the public concerning the Prospectus as described in the  Public Notice & Plan Details” attachment.     The applicant, Delmarva Power and Light Company, proposes to enclose/pipe approximately 330 feet of an unnamed tributary to the Christina River in order to create a parking lot. Delmarva Power & Light is in the process of redeveloping and realigning their operations at the 401 Eagle Run Road site in Newark, Delaware 19702.  The applicants stated purpose is to move the existing employee parking lot to the main property so that employees will no longer need to cross Eagle Run Road by foot.     The applicant, the Borough of Beachwood, Ocean County, New Jersey, has proposed to construct a 40 linear foot vinyl and timber bulkhead and pile extension immediately adjacent to the existing "T"-shaped dock (16 timber pile segments to be driven), construct rock toe stabilization (220 cubic yards of crushed stone and rock) over 1,980 square feet (0.045 acre) of waterway below the high tide line along the proposed and existing bulkhead area (including extension), and to re-grade the existing beach with 1,040 cubic yards of sand to be placed over 0.64 acre of waterway below the high tide line. The location for the work is along the Eastern shoreline of Toms River, along Bayside Avenue, Borough of Beachwood, Ocean County, New Jersey. The applicant's stated purpose of the project is to reduce erosion along the eastern shoreline of Beachwood Beach. Public comments are due by March 30, 2019.   • Special Public Notice - Clean Water Act Proposed Rule For A Revised Definition Of The “Waters Of The U.S.”

    The U.S. Environmental Protection Agency (EPA) and the Department of the Army announced the publishing in the Federal Register of the proposed new definition of "waters of the United States" that clarifies federal authority under the Clean Water Act. The agencies' proposal is the second step in a two-step process to review and revise the definition of "waters of the United States" consistent with the February 2017 Presidential Executive Order entitled "Restoring the Rule of Law, Federalism, and Economic Growth by Reviewing the 'Waters of the United States' Rule." The publishing of the proposal and outreach efforts were delayed due to the lapse in appropriations for EPA. Today's notice begins a 60-day public comment period that will close on April 15, 2019. EPA and the Army will hold an informational webcast on February 14, 2019, and will host a listening session on the proposed rule in Kansas City, KS, on February 27-28, 2019.
